Mineral Wells City Council on Tuesday failed to resolve a special use permit request for a third liquor store in the city, and an attorney for the applicant said legal action might be necessary if the city fails to adhere to its recently enacted zoning policy.
City officials are contemplating their next move on a request to locate a package store at 700 S.E. 6th Ave., Suite C. The request has drawn protests from nearby Calvary Baptist Church and Mineral Wells ISD because of its proximity to Travis Elementary School.
However, the application meets the city’s 300-foot buffer zone requirement.
Attorney John Gamboa, representing applicant Jeff Stricklen, said taking the city to court to ask a judge to force the city to approve the permit request could be costly.
“Citizens are going to say, ‘Couldn’t that money have been better spent on the police department or the fire department?’” he said.
